1. Agreement to Terms

By accessing or using the Questrr application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are 13 years of age or older, and possess the legal capacity to enter into these Terms.

warning 3. PHYSICAL ACTIVITY, DARE & PUNISHMENT DISCLAIMER (CRITICAL)

Questrr is a gamified application that allows user groups ("Squads") to create tasks ("Quests"), assign challenges ("Dares"), and suggest penalties ("Loser Punishments") to be executed in the physical, real world (including, but not limited to, sports, fitness, dietary actions, stunts, or travel).

YOU EXPRESSLY AGREE THAT PARTICIPATION IN ANY REAL-WORLD QUESTS, DARES, OR PUNISHMENTS INVOLVES INHERENT RISKS OF BODILY INJURY, PHYSICAL HARM, ILLNESS, PSYCHOLOGICAL STRESS, PROPERTY DAMAGE, OR DEATH.

BY UNDERTAKING ANY ACTIVITY ASSOCIATED WITH THE APP, YOU VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN. QUESTRR, ITS FOUNDERS, DEVELOPERS, ASSOCIATES, AND PARTNERS DIRECTLY DISCLAIM ALL LIABILITY FOR ANY ACCIDENTS, INJURIES, ILLNESSES, LITIGATIONS, OR DEATH THAT OCCUR IN CONNECTION WITH DISCORDANCE, COMPETITIONS, OR REAL-WORLD TASKS INITIATED THROUGH THE SERVICE.

All tasks and dare activities are self-assigned, self-directed, and completed voluntarily. Questrr does not verify, monitor, approve, or recommend any specific physical actions. Always use common sense and act safely. Do not attempt illegal, hazardous, or harmful deeds.

4. User-Generated Content & Verification

Questrr allows users to upload custom messages, images, photos (such as camera "Photo Proofs" of quest completions), and custom titles. You retain ownership of your content, but grant Questrr a worldwide, royalty-free, sublicensable license to host, display, and process your content for the sole purpose of operating the Service.

You represent and warrant that your content does not violate any third-party rights, copyright laws, or privacy rights. You agree not to upload, post, or share any content that is profane, obscene, harassing, abusive, illegal, or physically dangerous. Questrr uses client-side filters but does not guarantee complete moderation and is not responsible for user-generated content.

5. Account Registration and Safety

Access to the app may require authentication via third-party providers (such as Google Authentication via Firebase). You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you sign in as a Guest, your account is stored locally, and clearing browser data will wipe access.

6. Prohibited Activities

You agree not to use the Service to:

  • Harass, bully, threaten, or intimidate other users.
  • Cheat, spoof database calls, or manipulate points systems to bypass fair gameplay.
  • Reverse-engineer, decompile, or scrape the application source code.
  • Circumvent passcode protections or access code gates.
  • Upload profanity or malicious content that bypasses input validations.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTRR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS.

8. Limitation of Liability

IN NO EVENT SHALL QUESTRR, ITS FOUNDERS, OR ASSOCIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF THE SERVICE OR COMPLETION OF REAL-WORLD QUESTS. IN NO EVENT SHALL TOTAL LIABILITY EXCEED FIFTY DOLLARS ($50 USD).

9. Indemnification

You agree to defend, indemnify, and hold harmless Questrr and its developers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, user content, or real-world activity completion.

10. Modifications and Termination

We reserve the right to modify or terminate the Service or these Terms at any time, for any reason, without notice. If we modify these Terms, we will update the "Last Updated" date. Continued use of the Service constitutes agreement to revised Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Delaware, USA, or the operator's primary jurisdiction, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the competent courts of the operator's jurisdiction.
